These Site Terms apply to your use of the Service. By visiting or using the Service, or by creating an account, you accept these Site Terms. Continued use of the Service constitutes your acceptance of any revisions to these Site Terms.

“Service” means rootpragmatic.com, any subdomain operated by Root Pragmatic LLC, the Root Pragmatic LLC application, and any other digital channel through which Root Pragmatic LLC maintains an established presence through a service or application.
“Root Pragmatic LLC,” “we,” “us,” and “our” mean the entity operating the Service, identified in Section 11 of the Root Pragmatic LLC Privacy Notice.
“You” and “your” mean the individual visitor or registered user accessing the Service.
This section provides legal disclosures about the content on the Service. You accept delivery of the following disclosures that relate to information at the Service.
Suggestions: Suggestions, summaries, and outputs displayed on the Service are not personalized recommendations unless expressly identified as such, and may not be appropriate for all users.
Tax, Legal, and Financial Advice: The Service is not intended to provide tax, legal, accounting, investment, or other professional advice. Consult a qualified professional advisor regarding your specific situation before making any tax, legal, or financial decision.
Foreign Jurisdictions: Root Pragmatic LLC is operated from the United States. The Service is intended for use by individuals located in jurisdictions where Root Pragmatic LLC is permitted by local law to make it available. We make no representation that the Service is appropriate or available for use in any other jurisdiction.
Company Identification: The Service is provided by Root Pragmatic LLC. Company contact information is set out in Section 11 of the Root Pragmatic LLC Privacy Notice.
Computer Requirements: To use the Service, you must have a personal computer or mobile device with internet access and a compatible web browser. You are responsible for the selection, installation, maintenance, and operation of your device and software. We are not responsible for any errors, failures, or malfunctions of your device or software. You are responsible for ensuring that your device and software are compatible with the Service. We reserve the right to change the system requirements for using the Service.
This section explains the rules for content you submit to the Service. We do not review or publish your content. We may disclose it only as described in the Root Pragmatic LLC Privacy Notice. You retain ownership of your content.
Your Content: “User-generated content” means any data, text, files, notes, or other material you create, input, or upload through the Service. As between you and Root Pragmatic LLC, you retain all ownership rights in your user-generated content.
Limited License to Operate the Service: You grant Root Pragmatic LLC a non-exclusive, royalty-free, worldwide license to host, store, transmit, and display your user-generated content solely for the purpose of providing the Service to you and complying with applicable law. We do not access, review, analyze, or use your user-generated content for any other purpose, including advertising, marketing, model training, or analytics.
Disclosure in Legal Actions: Root Pragmatic LLC will disclose user-generated content and account information only as described in the Root Pragmatic LLC Privacy Notice — that is, in response to a valid court order, subpoena, warrant, or other legally binding process, or with your express written consent. Where we are legally permitted to do so, we will notify you before complying.
Prohibited Content: You may not use the Service to store, transmit, or process content that is unlawful, infringing, defamatory, obscene, threatening, or that violates any third party’s rights. You are solely responsible for the lawfulness of the content you submit.
This section explains ways you are prohibited from using the Service, including using it for unauthorized commercial purposes, sending inappropriate communications, providing false information, accessing the Service without authorization, and improperly using Root Pragmatic LLC’s name.
Personal Use Only: You will use the Service only for your personal, noncommercial use unless you and Root Pragmatic LLC have agreed otherwise in writing. Use in connection with a sole proprietorship or single-owner small business in your name is considered personal use.
Electronic Communications: You may not send communications to Root Pragmatic LLC that are illegal, obscene, profane, threatening, defamatory, invasive of privacy, or infringing of intellectual property rights; or that contain harmful code, political campaigning, commercial solicitation, chain letters, or mass mailings; or that violate any applicable law, including the CAN-SPAM Act.
Access: You may not use the Service in any manner that could damage or overburden any Root Pragmatic LLC equipment or software. You may not use any means of systematic retrieval of data or other content from the Service, including scraping, crawling, or automated data extraction. You may not obtain, or attempt to obtain, access to any material or information on the Service that is protected by passwords or login credentials through any means not expressly authorized by Root Pragmatic LLC. You may not use the login credentials of another person, unless that person specifically authorized you to do so.
False Information: You may not intentionally provide any false information when you register for the Service or update your account profile.
Framing: You may not frame any Service content within another website or interface without our express written consent.
Links: You agree to obtain our permission before creating a hyperlink or similar link or connection to the Service in a manner that suggests endorsement, sponsorship, or affiliation.
Endorsements: You may not use Root Pragmatic LLC’s name or trademarks in any way that implies affiliation with, or an endorsement, sponsorship, or approval by, Root Pragmatic LLC without our express written permission.
This section explains that we do not control third parties that may be linked from the Service.
The Service may contain links to other internet sites that are not maintained by Root Pragmatic LLC. Unless otherwise stated, Root Pragmatic LLC makes no warranties or representations regarding those websites or the products or services offered on them. Root Pragmatic LLC does not control the privacy or security practices of third parties, or the locations where they process data. You should read the privacy and security policies of any third-party site you visit, as their practices may differ from ours.
This section explains how to respect the intellectual property of Root Pragmatic LLC, how to report copyright infringements, and how we will treat ideas you submit to us.
Unsolicited Submissions: Unless otherwise stated, Root Pragmatic LLC does not accept unsolicited ideas, suggestions, or materials relating to development, design, or marketing of its services and products. Any such postings to the Service or communications delivered to Root Pragmatic LLC (other than user-generated content stored within your account, which is governed by Section 4) will be considered non-confidential and non-proprietary, and will remain the exclusive property of Root Pragmatic LLC. Root Pragmatic LLC may copy, disclose, distribute, incorporate, and otherwise use the item and any information contained therein for any purpose without compensation. Personal information transmitted to us will be treated in accordance with the Root Pragmatic LLC Privacy Notice.
Root Pragmatic LLC Copyright: The Service, including its design, code, text, graphics, and other content authored by Root Pragmatic LLC, is the copyrighted work of Root Pragmatic LLC. Unless otherwise specified, no person has permission to copy, display, distribute, republish, or create derivative works from such material in any form. This restriction does not apply to your own user-generated content.
Trademarks: By providing content, we do not allow you to use trademarks referenced on the Service. You may not use any meta tags or any other “hidden text” using Root Pragmatic LLC’s name or trademarks without our express written consent. The trademarks, logos, and service marks (“Marks”) displayed on the Service are the property of Root Pragmatic LLC or other parties. You are prohibited from using any Marks without the written permission of Root Pragmatic LLC or the third party that owns the Marks.
Copyright Infringement Claims: It is our policy to respond to notices of alleged infringement that comply with the Digital Millennium Copyright Act. If you believe that any material contained on the Service may infringe on your copyright, notice must be given in writing of the following: (a) identification of the copyrighted work claimed to have been infringed; (b) identification of the allegedly infringing material; (c) information sufficient to permit Root Pragmatic LLC to locate the infringing material; (d) a statement that the complaining party has a good faith belief that use of the material is not authorized or permissible by law; and (e) a statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the copyright owner, agent, or licensee. Anyone who knowingly misrepresents that material is infringing in such a notice will be liable for any damages and any associated costs incurred by Root Pragmatic LLC. You may close your account at any time using the controls provided within the Service or by contacting us. Root Pragmatic LLC may suspend or terminate your account if you materially breach these Site Terms, if continued provision of the Service to you would expose Root Pragmatic LLC to legal liability, or if Root Pragmatic LLC ceases to operate the Service. Upon termination, the Root Pragmatic LLC Privacy Notice governs the retention and deletion of your personal information and user-generated content.
This section disclaims warranties and limits liabilities related to the Service.
The Service is provided by Root Pragmatic LLC on an “as is” and “as available” basis. To the full extent permissible by applicable law, Root Pragmatic LLC disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Root Pragmatic LLC will not be liable to you or anyone else for damages of any kind arising from the use of the Service, inability to use the Service, or circumstances beyond its control, including, but not limited to, direct, indirect, incidental, punitive, and consequential damages, even if Root Pragmatic LLC is expressly advised of the possibility of such damages. Some states do not allow limitations on warranties or certain damages. Therefore, some or all of the above disclaimers, exclusions, or limitations may not apply to you, and you might have additional rights.
This section describes the law that will apply, and how and where we will handle disputes. It also has provisions that help in interpreting this agreement and how it relates to other agreements you may have with us. It describes how the agreement may be changed by us and the last date it was modified.
Governing Law: Use of the Service and these Site Terms shall be governed by and construed in accordance with the laws of the State of Texas without giving effect to any principles of conflicts of laws. The Uniform Computer Information Transactions Act or any substantially similar law, if enacted, will not govern any aspect of these Site Terms or your access to the Service.
Jurisdiction and Venue: Exclusive jurisdiction and venue for any claim or dispute arising out of or relating to these Site Terms or the Service shall be with a court of competent jurisdiction in Travis County, Texas. You consent to the jurisdiction of such courts and agree to accept service of process issued by such courts.
Severability: If any provision of these Site Terms is unlawful, void, or unenforceable, the remaining provisions shall remain valid and in effect to the fullest extent possible.
Waivers: Any waiver of any provision of these Site Terms will be effective only if in writing and signed by an authorized representative of Root Pragmatic LLC. Any delay or omission by Root Pragmatic LLC to exercise any rights under these Site Terms shall not be construed to waive any rights.
Section Headings: The section titles and the introductory explanations at the start of each section are provided for convenience only and are not part of the agreement. They are not to be used in interpreting the terms of the agreement.
Notices: If you have registered for the Service, we will notify you of any material changes to these Site Terms using the email address you have provided to us. These changes will not apply to disputes that arise prior to the effective date of the change.
Survival: Certain provisions of these Site Terms by their nature shall continue in full force and effect after termination, including authorizations you have granted, the Disclaimer of Warranties and Limitation of Liability, the Intellectual Property provisions, and Jurisdiction and Venue.
